Usage Rights for Content

You have been transferred here because we, Beliani Group AG (and all its subsidiaries and affiliated companies, hereinafter: Beliani), have requested your consent to use your photos, videos, and other graphic or audiovisual materials (Materials) on our websites, in sales channels, marketing materials, newsletters, and on social media.

Thank you for taking the time to review this request.

We are giving you the opportunity to have your Materials displayed on our online shops, in our sales channels, and social media channels. To this end, we would like to obtain your explicit consent to comprehensively use these Materials as follows, including for commercial use:

I. By entering into cooperation with us, you grant us, free of charge, indefinitely (without any time limitations), without territorial restrictions (in all countries of the world), and without limitations regarding the content and method of use, the following rights:

• The right to fully use, edit, and modify your Materials — including cropping, shortening, editing, translating, adding text, graphics, music, voiceover, and logos, and combining Materials with other content — in whole or in part.


• The right to use the Materials in all Beliani online shops — in all countries and language versions — in particular on homepages, product pages, category pages, landing pages, inspiration galleries, newsletters, and other marketing materials.


• The right to publish the Materials on all current and future social media platforms (including Instagram, Facebook, YouTube, TikTok, Pinterest, LinkedIn) — both in the form of organic (free) publications and in paid advertising campaigns (including ads, sponsored posts, performance, and retargeting campaigns).


• The right to use the Materials on sales platforms and marketplaces where Beliani offers or will offer its products, as well as in related advertising tools.


• The right to use the Materials for advertising and promotional purposes online and offline — including in traditional media, printed materials (catalogs, leaflets, posters, packaging), outdoor advertising, at trade fairs, and at points of sale.


• The unlimited right to reproduce, distribute, make publicly accessible, and publicly display your Materials, in digital and analog form, in particular through the use of your image on our websites, sales channels, and social media profiles. Granting the right to such use of the Materials includes all forms of online offerings known and unknown at the time of granting consent.


• The right to grant further licenses (sublicenses) to Beliani group companies and entities acting on our behalf (e.g., marketing agencies, advertising and sales platforms) to the extent necessary to achieve the above objectives.


• The right to use your Materials in connection with other current and future Beliani projects.

II. You confirm that you are the owner of the rights transferred under Section I, and thus you can effectively grant these rights to us.

III. You confirm that the use of your Materials does not violate any personal rights of third parties. This also means that the persons depicted in the photos or videos (if any) consent to the use of these Materials within the scope described in Section I.

IV. You indemnify us from third-party claims, in particular for copyright and personal rights violations, which may be brought against us in connection with the exercise of rights resulting from this agreement. If you are aware of any violation of the agreed rights, you are obliged to notify us within 5 business days of obtaining such information.

V. For the purpose of using and distributing your Materials, we only process necessary data, i.e., your account name.

VI. The rights described in Section I are granted indefinitely. Either party has the right to terminate this agreement in written or electronic form, with a two-week notice period, provided that termination only takes effect for the future — it does not cover Materials that have already been used, published, or included in campaigns, catalogs, or other marketing materials before the date of termination; these may continue to be used by us to the existing extent.

VII. Any amendments or addenda to this agreement must be in written or electronic form. If an individual provision of this agreement or parts thereof is or becomes invalid, this does not invalidate the remaining provisions of this agreement. To the extent that a choice of governing law is permissible, this agreement is governed exclusively by the laws of the Federal Republic of Switzerland.
